General Sales Conditions

1. Object
1.1 These Terms and Conditions, drafted in April 2023, are intended, along with the order form and other elements mentioned therein, to regulate the terms and conditions under which the provision of the Online Store Service of Quinta do Vale da Perdiz, Lda., headquartered at Quinta da Ferreira – 5160-308 Torre de Moncorvo, registered under the unique registration and identification number for legal entities no. 505054205, with a share capital of €250,000.00 (euros), hereinafter referred to as QVP.
1.2 The purchase of any product on the QVP Online Store implies the acceptance of these Terms and Conditions.
1.3 All alcoholic beverages available for sale on the QVP Online Store can only be purchased by individuals of legal drinking age in their country of residence.

2. Product Information, Prices, and Content
2.1 QVP reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on products, prices, promotions, commercial terms, and services.
2.2 The images illustrating each product on QVP may differ from the product subsequently delivered, and these products may also be subject to stock shortages.
2.3 Despite QVP’s efforts, some products may have an inaccurate price, which is why QVP verifies prices whenever orders are processed. Consequently, the prices displayed on QVP are indicative and do not constitute a contractual proposal. If the actual price of the product is lower than the advertised price, QVP will refund the difference. If the price is higher, QVP will inform the customer of this situation by email and await their decision to accept the new price or cancel the order within 15 days from the date the email was sent.
2.4 Under Portuguese law, all prices displayed on QVP include the applicable VAT rates, unless otherwise indicated.
2.5 Promotions and prices advertised on QVP may not apply to physical stores.

3. Ordering and Payment
3.1 After order confirmation on QVP, an email will be sent to the contact address provided by the customer during the order process, containing all details about delivery, billing, payment information, products, and amounts. QVP recommends that all customers verify the order details. If the customer does not receive the order confirmation email, they are requested to contact QVP using the provided contacts to have the notification resent to their email address.
3.2 If any of the details provided by the customer in the order are incorrect and/or the customer wishes to change any information, provided that the order has not yet been shipped, the customer should contact QVP as soon as possible using the provided contacts to request the necessary changes. Changes to details of orders already shipped will need to be evaluated by the QVP team to find the most suitable solution in conjunction with the customer.
3.3 All orders on QVP will only be processed upon receipt of payment. The formalization of the order itself does not constitute a reservation of the products.
3.4 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by QVP to find the most suitable solution.
3.5 All orders placed on QVP have a maximum payment period of 48 hours. After this period, the order will be automatically canceled.
3.6 Orders can be canceled when explicitly requested by the customer through the provided contacts before the orders are shipped. After the order is confirmed as shipped, the customer is requested to contact QVP so that, together, the most suitable solution can be found.
3.7 QVP’s Online Store accepts payments through Multibanco Reference, MB WAY, Payshop, VISA.
3.8 Order statuses on QVP are divided into 3 phases: Pending, In Processing (On Hold), and Completed.
a) Pending – Awaiting payment to enter QVP’s system;
b) In Processing – Payment has been received, and the order is being processed and packaged/prepared;
c) On Hold – Awaiting additional confirmations from the customer to proceed with the order. An exceptional phase.
d) Completed – The order has been shipped/sent.
3.9 Payments are received in euros, regardless of the currency used for the transaction. Conversion fees for payments made in other currencies must be borne by the customer.
3.10 In some cases, our customer support department may request documents in order to proceed with order processing.

4. Shipping Costs
4.1 The prices displayed on products include the cost of transportation, so no additional charges related to order delivery will be applied.

5. Shipments and Deliveries
5.1 Deliveries will be made throughout the Continental Territory, and in general, after shipment, an order at QVP takes between 1 to 5 business days to be delivered;
5.2 After orders are shipped, tracking information will be available in the accounts of customers who placed orders with registration, and a notification email with the tracking link will also be sent to all registered and non-registered customers. If for any reason the customer does not receive the shipping confirmation, they should contact QVP using the provided contacts to have all available information about the shipment re-sent to their email address.
5.3 After the shipment notification, customers should monitor the shipment’s status through the link provided by QVP to stay informed about its progress until the order is delivered, as QVP does not notify of every change in the shipment’s status.
5.4 All products shipped by QVP must be checked upon delivery. If the customer finds that the order is damaged, they should return it immediately to the transport company, justify the return reason properly on the carrier’s waybill, and promptly notify QVP using one of the provided contacts.
5.5 If, after delivery, the customer finds that any of the items are not in compliance, they are requested to contact QVP immediately via the provided email, indicating the order number or the document number accompanying the order, attaching images of the packaging as received and of all items, so that an internal investigation process can be initiated, and the situation can be resolved as quickly as possible.
5.6 QVP has contracted services with specialized carriers for the purpose of deliveries in Continental Portugal. Every effort is made to meet shipping and delivery deadlines; however, it should be noted that potential delivery delays may be beyond QVP’s control, and in such cases, precise delivery times cannot be guaranteed.
5.7 Most deliveries are made during business hours on business days at the shipping address provided by the customer when submitting the order.
5.8 In case of delivery attempt by the transport company without success due to absence, a delivery attempt notice with instructions will always be left in the customer’s mailbox. Depending on the service and the carrier, orders should either be collected at the location indicated by the notice or the instructions on the notice should be followed.
5.9 If, for any reason, the customer cannot receive the order or collect it from the location indicated by the carrier, the customer is requested to contact QVP so that the most suitable solution can be found together.

6. Returns Policy
6.1 QVP recognizes the right of all its customers to rescind contracts entered into with it, allowing them to return products purchased within 30 (thirty) days, in accordance with Decree-Law No. 109-G/2021 and Decree-Law No. 84/2021 of December 10, 2021.
6.2 For exchanges or returns, the customer is requested to contact QVP through the provided email, indicating the order number or the accompanying document number, taking into account the conditions described below in the following topics:

a) To return the order, the product must be in perfect condition, and if applicable, with its original packaging, accessories, or included promotional offers, and accompanied by the proof of purchase or invoice.
b) The return of defective products and incorrect shipments will be accepted, with QVP being responsible for shipping and collection costs whenever the customer communicates this circumstance within 30 (thirty) days from the date of receipt of the product.
c) Once the merchandise is received at our premises and after validation of its condition in compliance, the value will be refunded in accordance with the payment method used by the customer, or another solution previously agreed with them.
6.3 QVP assumes responsibility for defects in origin or raw material of the purchased product, and if this is confirmed by the specialized QVP team, the product will be exchanged or refunded at no cost to the customer.
6.4 QVP will not accept the return of a product after it has been used, or if it has been altered or modified.
6.5 QVP is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions, or force majeure.

7. Applicable Law
7.1 All purchases made on the QVP website are subject to Portuguese law. Any conflict or divergence in the interpretation of the General Online Sales Conditions will be submitted to the competent Portuguese court.
7.2 If the Customer is outside Continental Portugal, QVP hereby informs that any legal proceedings must be exclusively initiated in Portuguese Courts.
7.3 Under the terms and for the purposes of the provisions of article 18 of Law No. 144/2015, of September 8, it is informed that the available RAL entity is the National Center for Information and Arbitration of Consumer Conflicts (CNICC) with the following contacts:
